Amend 2016 Tax Levy Rates

9:00am

The Callaway County Commission met to amend the 2016 tax levy rates and to discuss surplus money from the 2014 Land Tax Certificate Sale. Denise Hubbard, County Clerk, was also present for this meeting.

Commissioner Jungermann began by explaining that the Commission originally set the 2016 tax levy rates on August 22. However, a revision to the Road & Bridge rate had just been completed two weeks prior, and the Commission had not received the official rate back from the State Auditor at the time the rates were set. Since then, the State Auditor has sent the County the maximum rate allowed and the Road & Bridge rate is slightly off. This rate was set at 0.2608 and the maximum rate allowed should be 0.2607. The 2016 tax levy rate for General Revenue was correct and has stayed the same.

Eastern District Commissioner Randy Kleindienst made a motion to amend the 2016 tax levy rates to be set at 0.3368 for General Revenue and 0.2607 for Road & Bridge.

Presiding Commissioner Gary Jungermann seconded the motion.

All in favor…ayes have it. Court Order #88 — signed.

Court Order #88 — Amend 2016 Tax Levy Rates

Now on this day, the Callaway County Commission does hereby vote and amend the 2016 tax rate levies to be set as follows:

General Revenue –      0.3368

Road & Bridge -                     0.2607

Surplus Money from 2014 Land Tax Certificate Sale

Next, the Commission discussed surplus money from the 2014 Land Tax Certificate Sale. Commissioner Jungermann explained that Silver Springs Farms is forfeiting a lien it purchased at the 2014 Land Tax Certificate Sale. The owner, David Rocklitz, paid the delinquent taxes for three properties at that time; however, he did not fill out the appropriate paperwork in the time allotted and therefore does not get ownership of these properties. Ownership of these properties will revert back to the original owners at the time of the Tax Sale. While Mr. Rocklitz cannot get the tax money back, he has a right to the surplus money he paid over the amount of the delinquent taxes for the properties. The surplus totals $1,490.06.

Eastern District Commissioner Randy Kleindienst made a motion to authorize Debbie Zerr, County Treasurer, to refund $1,490.06 to Pam Oestreich, County Collector. This is tax sale surplus money that was turned over to the County Treasurer on September 16, 2014 (Receipt #2488) as unclaimed surplus from the 2014 Land Tax Certificate Sale. This surplus is for Silver Spring Farms, LLC. The owner of Silver Spring Farms, LLC, David Rocklitz, is forfeiting his lien on three properties he bought at the 2014 Land Tax Certificate Sale and is requesting all surplus monies from the sale be returned to him.

Presiding Commissioner Gary Jungermann seconded the motion.
