The Callaway County Commission met with the Presiding Commissioner Gary Jungermann, Eastern District Commissioner Randy Kleindienst, and Western District Commissioner Donald Kritzer present.

 

Surplus Property

 

9:30am

The Callaway County Commission met to discuss surplus property and a Tri-State bill. Deborah Goldman was also present for this meeting to represent the County Clerk’s office.

 

First, the Commission discussed surplus property from the County Collector’s office. The property is a money counter that was purchased in 2009 that is no longer working and has been marked as junk.

 

Eastern District Commissioner Randy Kleindienst made a motion to declare a money counter from the Collector’s office, Tag #3874, as surplus property to be disposed of as junk.

 

Western District Commissioner Doc Kritzer seconded the motion.

 

All in favor…ayes have it.

Court Order #58 — Surplus Property

 

Now on this day, the Callaway County Commission does hereby declare the following as surplus property, to be disposed of as junk:

Tri-State Bill

 

Next, the Commission discussed a Tri-State bill for repairs to a Road & Bridge motorgrader. The bill covers miscellaneous repairs and a high amount of labor, due to the difficulty of reaching the parts in need of repair.

Eastern District Commissioner Randy Kleindienst made a motion to approve a payment to Tri-State in the amount of $15,997.07 for repairs to a 2008 670D John Deere motorgrader (#48).

Western District Commissioner Doc Kritzer seconded the motion.

 

All in favor…ayes have it. Court Order #59 — signed.

 

Court Order #59 — Tri-State Bill

 

Now on this day, the Callaway County Commission does hereby approve a payment to Tri-State in the amount of $15,997.07 for repairs to a 2008 670D John Deere motorgrader (#48). This bill will be paid out of the Road & Bridge Maintenance fund.

 

Property Issue

The Callaway County Commission met with Jean Danuser and Bill Gard to discuss a property issue. Deborah Goldman was also present to represent the County Clerk’s office.

 

Ms. Danuser began by giving some background on her property. This property has a private driveway off of Old Highway 54 that has an old bridge; Ms. Danuser wants the County to help maintain this bridge. She then presented the Commission and Mr. Winkelmann with several documents, including letters, maps, and her late mother’s diary, that refer to the bridge in her driveway from as early as 1930. According to the documentation, it seems that the State built this bridge so that materials could be moved.

 

In 1998, MoDOT’s inventory was given to Callaway County, including Old Highway 54; however, this driveway was not included in the inventory, as it is a private drive. Callaway County has never maintained this driveway.

 

Finally, Ms. Danuser informed the group that she is planning to meet with an attorney to confirm ownership/responsibility of the bridge. She stated that if this issue goes to court, the State of Missouri (MoDOT) and Callaway County will be named in the lawsuit. The Commission and Mr. Winkelmann said that they would all research statute to ensure that the County is not responsible for a bridge that is located on a private driveway.
