**Emergency Meeting Called**

The Callaway County Commission met with the Presiding Commissioner Gary Jungermann, Eastern District Commissioner Randy Kleindienst, and Western District Commissioner Donald Kritzer present.
The Callaway County Commission called an emergency meeting per RSMo 610.020.4 to revise a Court Order regarding the approval of submitting a local use tax to be placed on the April, 2016 ballot. Deborah Goldman was also present for this meeting to represent the County Clerk’s office.
Commissioner Jungermann explained that today is the deadline to submit the Callaway County use tax to the State of Missouri for it to go into effect on July 1, 2016. Court Order #9, dated January 12, 2016, authorizes the submission of the use tax issue for the April, 2016 election. However, the Commission wants to clarify the statute number and the percentage of the use tax before submitting this documentation to the State.
Western District Commissioner Doc Kritzer made a motion to amend Court Order #9, dated January 12, 2016, for clarification purposes. The Court Order should clarify the proposed use tax rate, which is currently at 1%, and should also state that the Commission has the authority to place the use tax issue on the ballot pursuant to RSMo 144.757.
Eastern District Commissioner Randy Kleindienst seconded the motion.

Court Order #56 — Amend Court Order #9 Regarding Use Tax Ballot Issue
Now on this day, the Callaway County Commission does hereby amend Court Order #9, dated January 12, 2016, to read as follows:
Now on this day, the Callaway County Commission does hereby impose a local use tax in
Callaway County as per the passage by the vote of the people to be set at the same rate as the total local sales tax, currently one percent (1%), pursuant to the authority granted by Section 144.757, RSMo. The ballot language read as follows:
Shall the County of Callaway impose a local use tax on out-of-state purchases at the same rate as the total local sales tax rate, currently one percent (1%), provided that if the local sales tax rate is reduced or raised by voter approval, the local uses tax rate shall also be reduced or raised by the same action? A use tax return shall not be required to be filed by persons whose purchases from out-of-state vendors do not in total exceed two thousand dollars in any calendar year.
The revenue generated from the use tax shall be dedicated to Public Safety areas, including the Callaway County Sheriff’s Department, Jail operations, and the Prosecuting Attorney’s office, and to Callaway County Road & Bridge operations.
The purpose of the proposal is to eliminate the current sales tax advantage that non-Missouri vendors have over Missouri vendors.
County Clerk’s Fees Filed
Now on this day comes Denise Hubbard, County Clerk, and files her report of fees collected by her office for the month of April, 2016. Said report was examined and ordered filed by the Clerk
of the Commission.
Vendor Checks Issued
Vendor checks were issued in the amount of $80,323.04.
